PRIVACY POLICY FOR THE PROCESSING OF PERSONAL DATA

(PURSUANT TO THE EU REGULATION 679/2016; Leg.D. 101/2018; Leg.D. 196/2003)

This policy is compliant with the provisions of art. 13 and 14 of the Regulation 679/2016 (EU) (“GDPR”), for those who access and browse on the website www.manelli.eu

This policy describes the Website management and personal data processing modes, which can be referred to the users, accessing it; therefore, any other third-party website, to which you can be addressed from the Website, is considered excluded.

With the use of this website, by providing to Manelli Impresa S.r.l. one’s own Personal Identification Data (as defined here below) or, otherwise, expressing one’s own consent in receiving marketing or other type of information, the User agrees to all the operations performed by Manelli Impresa S.r.l. in relation to one’s own Personal Identification Data as set forth in this Policy.

If the User disagrees with the terms and conditions of this Policy, he/she must not use the Website nor provide for his/her Personal Identification Data by means of the Website or in another way.

1- Purposes and legal basis of the treatment
The personal identification data of the user are collected directly to satisfy the requests, processed by the same. On this matter, the Website contains different modules, which the user must fill out, in order to be able to manage and follow up the requests, processed by the same. In particular, it is possible:

  • to register and access to the so-called reserved areas,
  • purchase the marketed products
  • request for information concerning the products and the services.

Moreover, the data may be acquired by the Data Controller, even indirectly, considering that, during the browsing activity on the Website, the IP addresses or the name of the domains of the computers, used by the users, who connect to the website, the addresses in URI (Uniform Resource Identifier) notation of the resources requested, the time of the request, the method used in submitting the request to the server, the size of the file obtained as a reply, the numeric code showing the status of the reply, given by the server (successful, error, etc.) as well as other parameters relating to the operating system and to the computer environment of the user are all tracked.

Moreover, the collection of the data may occur also by means of third sources, such as:

Manelli Impresa S.r.l. may also combine the Personal Identification Data with others of public domain and received by third parties or which refer to Personal Identification Data received by third parties. The collection and the use of Personal Identification Data in a separate or combined manner, are carried out in compliance with this Policy for the purposes described herein.

The Data provided shall be processed for: a) purposes connected to the correct and complete performance of the signed order (for such purpose, the consent is not required, since the data processing is related to the execution of the order); b) for purposes connected to the exercise of the rights of the Data Controller (e.g. legal defence); c) for purposes connected to the fulfilment of obligations provided by law provisions or regulations, as well as to the fulfilment of obligations, as laid down by the anti-money laundering regulation (for such purpose, the consent is not required, as the data processing is related to the respect of such obligations/law provisions and/or regulation); d) ordinary marketing activities (sending e-mails, mail, sms, newsletters, commercial or advertisement communications, etc.).

The data provided will be processed in a lawful, correct and transparent manner and exclusively for the purposes mentioned above. The relating treatment shall not exceed such purposes.

 

2- Type of Processed data

The types of processed data consist in “Personal Data”, that is the information, suitable to identify, directly or indirectly, a natural person. When browsing on the Website, the following data may be processed:

  • Name and Surname
  • Contact information (i.e., phone number and address, e-mail);
  • IP, domain name, URL used;
  • browsing data;
  • Browser version
  • The data intentionally provided in such context to use the services and purchase our products

3-  Redirect to external websites
The Website uses the so-called plug-ins, that is, special tools, which allow to incorporate the functions of the social network directly inside an Internet website.
Each of the social plug-ins present on the Website is identified with the logo, owned by the social platform, in the specific case, with the logo.
Shall the user interact with the social plug-in, the information, relating to the involved party, is directly conveyed to the social platform, which processes his/her Data, as an independent Data Controller, therefore, in order to obtain more details on the processing purposes and modes, the exercisable rights and the preservation of the personal data, please consult the privacy policy of the social network.

4- Cookies
The cookies are small text files, which the websites, visited by the users send to their computers, where they are saved, and then conveyed again to the same websites at the following visits. Generally, the company uses the so-called technical cookies required in order to guarantee the best functionality of the Website for the user.
To disable or refuse the use of the so-called cookies, it is possible in any moment to edit the settings of the browser of one’s own PC, by warning that the browsing of the Website and the usability of the relating contents may be compromised.

7- Transfer of personal data
The server farm, where the Website is located, is based in Italy.
The Data are not transferred to third-parties, located outside of the European Economic Area, shall such transfer be necessary, it shall be our concern to make sure that the recipients of the Data have adopted suitable safety measures to assure protection of the same.

8-  Processing modes
The processing of the Personal Data provided shall be carried out according to the principles of correctness, lawfulness and transparency; it will be performed in an automated manner and/or manually, in compliance with the safety measures, pursuant to art. 32 of the GDPR.
It is specified that the processing of the Personal Data will be carried out in compliance with the operations shown in art. 4 number 2) of the GDPR; therefore, the processing mode may consist in the collection, registration, organisation, structuring, preservation, adjustment or editing, extraction, consultation, use, communication by transmission, disclosure or any other form of making available, comparison or interconnection, limitation, deletion or destruction.

9-  Use mode of the personal identification data collected

Manelli Impresa S.r.l. collects the Personal Identification Data relating to private clients, the website visitors and others, in order to offer an experience, which satisfies their specific needs Manelli Impresa S.r.l. could collect, use and disclose Personal Identification Data for one or more of the following purposes:

 

  • Processing of offers and/or orders.
  • Reply to the request for marketing material, information or other
  • Sending administration-related communications or of other nature;
  • To send important information to the User, relating to the Website, relating to any amendments of the terms, conditions and policies performed or other administration-related information;
  • In order to carry out or facilitate surveys and ask the User to reply to surveys in order to provide for increasingly better products and services for clients and visitors of the Website. The completion of any surveys or questionnaires is completely voluntary.
  • Customer service. To track, process and reply to questions, addressed to the customer service and to optimise and improve customer experience, Manelli Impresa S.r.l. may also convey the Personal Identification Data of the User to third-party service providers, affiliated Organisations in order to allow such third-parties to track, process and reply to questions, addressed to the customer service.
  • In-house commercial purposes. For in-house commercial purposes, such as data analysis, development of new products, improvements of the Website, improvement of the services, identification of use trends and visiting schemes, definition of the efficiency of the promotions and respect of the contractual obligations.

10- Third-party websites
The Website could contain links to third-party Websites. Such websites are not controlled by Manelli Impresa S.r.l. which is not responsible for the privacy policies or the contents of such connected websites (or for any links present in a connected website).
Such links are provided only for convenience and the integration of a link on the Website does not imply the approval of the connected website by Manelli Impresa S.r.l. or by its Subsidiaries. Shall the User decide to access third-party Websites connected to the Website, he/she shall do it at his/her own exclusive risk according to the terms and conditions of use and to the privacy policies of such Websites.  If the User provides for Personal Identification Data by means of a third-party Website, the Personal Identification Data provided shall be processed in compliance with the privacy policy of such third party.

11- Communication of data to third parties
The Data shall be processed by the Data Controller, by the Data Processor and by the appointees, pursuant to art. 30 of the Code for the Protection of Data and art. 29 of the GDPR.
The Data may also be transferred to companies/professional firms, which provide for assistance, consulting, collaboration activities to the data controller as for accounting, administrative, fiscal, legal, tax and financial purposes, to public authorities within the limits, set forth by the law or by regulations and to third-party service providers, for which the communication is required for the fulfilment of the activities, subject of the order and/or contract
In any case, the use of such subjects shall take place prior to commitment by the same to respect the regulation, relating to privacy.
The Data shall not be subject to disclosure.

12- Intention of the Personal Data Processing Controller
The Data Controller shall have no intention to transfer the Data collected to a third country or to an international organisation.

13- Data storage period
The Data provided shall be stored for a period not exceeding 1 (one) year from the deletion request of the user from the database, sent via e-mail to info@manelli.eu
Upon expiry of the above-mentioned terms, the Data shall be destroyed.
Finally, we shall reserve the right to store the so-called log-in and log-out data for a longer period, in order to be able to manage any crimes perpetrated against the Website (hacking activities).

14- Compulsory or optional nature of data provision and consequences of any refusal to reply
The provision of Data for the purposes shown under point 1 letters a) and b) is required for the correct and complete execution of the order and any refusal on the matter shall entail the impossibility to carry out the activities, subject of the order. The provision of the Data for the purposes set under point 1 letter c) is compulsory, as they are required for the fulfilment of the legal requirements. The provision of the Data for the purposes set under point 1 letter d) is optional.

15- Existence of an automated decision-making process
An automated decision-making process is not present.

16- Rights of the interested party and procedure for the exercise
The interested party has the rights, as per articles 15-22 EU Regulation 2016/679 (access to personal data, amendment or deletion (“right to be forgotten”) of the same or limitation of Data processing, concerning the party, right to oppose to their processing, right to Data portability; right to withdraw consent in any moment without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal and has the right to submit a claim to a supervisory authority). The rights may be exercised in any moment, by sending a registered letter with return receipt to the company in the person of its Administrator and pro-tempore legal representative or an e-mail to the address info@manelli.eu or a certified e-mail to the address info@manelli.eu.

17- Data Controller and Data Processor
The Data Controller and Processor of the treatment is Manelli Impresa S.r.l., in the person of its Administrator and pro-tempore legal representative, based in Monopoli (BA) – Via Clemente Cancelli, 11 – Italy VAT N. / Tax number IT06746680724.

18 – Amendments to the policy
The data controller shall reserve the right to make amendments to thi Policy in any moment. The date of the latest update of this Policy is reported at the beginning of this page. In case of substantial amendments to this Policy, the data controller shall inform on the Website that its own privacy policy has been amended, providing a link to the new version. In case of substantial amendments to its own modes of use of the Personal Identification Data of the User, Manelli Impresa S.r.l. shall provide to inform the User via e-mail at the e-mail address specified on his/her account (where applicable) and/or by means of a notification published on the home page of the Website, offering him/her the possibility to refuse such new or different use. Any amendments to the Policy shall become effective, as soon as the new version of the Policy is published on the Website
The use of the Website after the publication of such amendments entails the acceptance by the User of the new version of the Policy in force.
